We spoke with Eraldo D'Atri and Jemima Roe of Clifford Chance about their pro bono case on behalf of Christie Elan-Cane. The case centres around the UK government's refusal to issue non-gendered (X) passports. In pursuing this case, Clifford Chance are hoping to take a vital step in the battle for equal rights for the trans community, intersex people and those who identify as non-gendered. While the case was initially dismissed, the UK Courts have recognised that the European Convention on Human Rights (Article 8) guarantees a right to respect for non-gendered identity for the first time. A decision is expected on the appeal on Tuesday, 10th March 2020.
